The issue this case presents for resolution is whether defendants convicted of violating Maryland Code (1957, 1996 Repl. Volume, 2001Cum. Supp.) Article 27, § 291A,1 are eligible to receive the benefit of probation before judgment2 pursuant to Maryland Code (2002) § 6-220 (d) (2) of the Criminal Procedure Article.3 The trial court, the Circuit Court for Baltimore County, which imposed the disposition, and, subsequently, on appeal, the Court of Special Appeals, concluded that the defendants were, in fact, eligible to receive probation before judgment. We shall affirm. I.
